In this Returns Policy the expressions “we”, “us”, “our” and “The 5TH” are a reference to The Fifth View Pty Ltd ABN 12 601 372 105 trading as The Fifth Watches, https://www.the5th.co/ (“Website”)
The expressions “you” and “your” mean you, the customer as purchaser of any of the products available on our Website (“Products”).
This Returns Policy is to be read in conjunction with our Terms and Conditions.
2. AUSTRALIAN CONSUMER LAW
The 5TH complies with its obligations under Australian Consumer Law. This document sets out your rights in addition to the Consumer Guarantees provided by the 5TH under Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure
3. EXCHANGE POLICY
The 5TH will accept an exchange for change of mind purchases, or where you have received an incorrect Product in your shipment, subject to compliance with this Exchange Policy.
To be eligible for an exchange, the Product must be:
a) returned within 14 days;
b) in the same condition as it was received by you;
c) both protective stickers in place on the face and case back of the watch having not been removed, and
d) plastic insert in the crown of the watch remaining in place.

4. WARRANTIES AGAINST DEFECTS
All Products come with a 24-month manufacturer’s warranty which is provided by the 5TH as a warranty against defects under Australian Consumer Law (“Warranty”). The Warranty excludes general wear and tear, including general wear and tear on the strap.
If you receive a Product which you believe to be faulty or defective, or if a fault or defect becomes evident to you in respect of a Product within the first 24 months’ of the purchase date, we will repair or replace the Product for you.
How to Claim under Warranty:
a) Please stop using the Product immediately the fault or defect becomes evident.
b) Contact us by online form submission via our returns page.
c) Provide all details or the fault or defect to us, including a photo of the fault or defect where possible – we will then contact you to arrange return of the Product to us and provide you with the postal address of our warehouse location closest to you (“designated returns centre”).
d) All returns must be sent via standard post with tracking to the designated returns centre. We are happy to reimburse for your costs of postage up to the following amounts:
Customers in Australia or New Zealand to a maximum of $30AUD
International Customers to a maximum of $20USD
To claim your postage reimbursement, please email us a copy of your receipt for postage to: email@example.com
e) We will make contact with you as soon as your return Product is received and processed. If you have been waiting longer than ten (10) days, please let us know so that we can look into the status of your return for you.
f) If the fault or defect can be repaired (“minor failure”) we will arrange for repair of the fault or defect on your behalf. If the fault or defect cannot be repaired (“major failure”) we will arrange a refund to the value of your Product, or a replacement of the Product if you choose.

No part of our Warranty is intended to reduce, restrict or limit your rights under Australian Consumer Law. If a major failure has occurred with your Product, you are entitled to a full refund under Australian Consumer Law.
